Atelier — Beta Tester Confidentiality Agreement
Non-disclosure agreement for early access to pre-release software
Between: Fabrique Du Souk Inc., doing business as The Souk Galaxy, Terrebonne, Québec, Canada (“we”)
And: (“you”), email:
We’re giving you early access to an unreleased software product, codenamed Atelier (the “App”). In exchange, you agree to the following:
- What’s confidential. Everything about the App that isn’t public: the builds, features, user interface, performance, roadmap, pricing plans, license keys, our discussions with you, and the existence of the beta program itself (“Confidential Information”).
- Keep it private. You will not share Confidential Information with anyone. Specifically, you will not:
- share, post, or stream screenshots, recordings, or descriptions of the App — anywhere, including social media and private group chats — unless we authorize it in writing;
- give the build, installer, or your license key to anyone else. Your access is personal and non-transferable;
- decompile, reverse engineer, or extract assets from the App.
- What’s not confidential. Information that is already public (not through your fault), that you knew before this agreement, or that you must disclose by law (tell us first if legally allowed).
- Feedback. We can freely use any feedback, ideas, or suggestions you give us — in the App or otherwise — without payment or credit owed. We’re under no obligation to use them.
- Beta software. The App is pre-release and provided as-is. It may break, corrupt files, or change at any time. Back up your work.
- Term. These obligations start when you accept and end when the App is publicly released, or 24 months after acceptance, whichever comes first.
- If this is breached. A leak could cause harm that money can’t fix; we may seek injunctive relief in addition to other remedies.
- Governing law. Québec, Canada. Les parties confirment leur volonté expresse que cette entente soit rédigée en anglais. The parties confirm their express wish that this agreement be drafted in English.
Acceptance. Replying to the email delivering this document with “I agree” (with your full name) constitutes your signature and acceptance.
